BM&S Partner Dana Marjieh and Associate John Caruso Secure Voluntary Discontinuance in High-Stakes Breach of Contract Case

In a recent breach of contract action involving a multi-million dollar New York City Public Improvement project in Brooklyn, plaintiffs alleged trust fund diversion, unjust enrichment, and sought to recover upwards of $18 million. While claims were asserted against multiple defendants, BM&S attorneys Dana Marjieh and John Caruso identified that the plaintiffs failed to state a cause of action against their client and moved for pre-answer dismissal.

Faced with the strength of the motion, plaintiffs opted not to amend their complaint but instead voluntarily discontinued their action with prejudice as against the BM&S client. Thanks to Dana’s and John’s zealous advocacy, their client is now fully protected from further involvement in this high-value litigation.
