Previously, a design professional’s liability was limited to those parties with whom the design professional had a contract – but modern tort law has eroded this safeguard.
The one-hour webinar discussed the importance of managing exposure to claims outside of the contractual chain.
Topics that were discussed included:
- What the traditional privity rule was and how it has evolved.
- Contract provisions that will help maintain contractual protections against third party claims.
- Practical implications of the erosion of contractual privity, including a discussion of the consideration of mediation and/or arbitration clauses in contracts to proactively avoid litigation for claims “arising” from the contract.
The webinar also highlighted claims scenarios and lessons learned to illustrate how the law has changed the way we handle claims, and how our insureds manage their projects.
