BM&S Partner John W. Bieder Obtains Summary Judgment in Labor Law Case, Dismissing All Claims Against Client
In a recent win for Black Marjieh & Sanford LLP, Partner John W. Bieder obtained a summary judgment in a labor law case, dismissing all claims against the client. The Court further ordered Third-Party Plaintiff to reimburse all legal expenses expended during the course of the litigation.
In this matter, in which the Plaintiff suffered injuries due to a collapsing wall during debris removal, John was able to establish that BM&S’ client, an engineer responsible for providing plans for the lowering of a wall damaged by fire, had no responsibility for work being performed by Plaintiff and therefore all common law and contractual indemnity claims against same should be dismissed. Further, based on the contractual indemnification language, contained in the engineer’s contract with the owner, the Court awarded the client reimbursement of all legal expenses expended during the course of the litigation.
