BM&S Partner John W. Bieder and Associate Victoria Luciano Secure Dismissal for Non-Profit in Construction Site Negligence Case

Bieder and Associate Victoria Luciano successfully secured the dismissal of all claims against our client, a non-profit organization dedicated to encouraging young girls to pursue careers in construction. The non-profit had been named as a Third-Party Defendant in a negligence case arising from the plaintiff’s claim that she tripped and fell on a construction site.
The court ruled in favor of our client, agreeing with our arguments that BM&S presented clear and compelling evidence demonstrating that our client was not involved in the project, did not perform any work or maintenance at the premises, and had no connection to the plaintiff’s accident. Furthermore, the court found no basis for contractual indemnity or breach of contract claims, resulting in the dismissal of all claims and crossclaims against our client.
