The case involved allegations that an insurance broker failed to procure requested third-party liability insurance or inform the plaintiff that such coverage was unavailable, leading to claimed damages associated with defending a separate lawsuit. The defendant moved to dismiss, arguing that documentary evidence, including an insurance application, demonstrated no such coverage was requested. The court agreed, finding the evidence conclusively refuted the claims and dismissed the case.
The plaintiff’s subsequent motion to reargue was denied, as Dana Marjieh successfully demonstrated that there was no misapprehension or oversight in the prior ruling.
